9. Intellectual property and your data

You retain ownership of your personal and financial data. By using the Service, you grant us a limited, non-exclusive licence to host, process and use your data solely to provide and improve the Service and as described in our Privacy Policy. We do not claim ownership of your content.

10. Disclaimers

No financial advice. Wealthra provides tools for tracking and analysing your finances and general information through its AI tools. We do not provide financial, investment, tax or legal advice. You should consult a qualified professional before making financial decisions.

Accuracy of data. While we strive for accuracy, we do not guarantee that transaction data, categorisations, AI outputs or reports are error-free. You are responsible for verifying the information.

Service availability. We aim to provide a reliable service but do not guarantee uninterrupted or error-free operation, including where interruptions arise from third-party providers.

11. Your rights under the Australian Consumer Law and limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the ACL.

To the extent we are entitled to do so, our liability for breach of a non-excludable guarantee is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

Subject to the above, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, and our total aggregate liability for all other claims is limited to the greater of the fees you paid us in the 12 months before the claim or AUD $100.

12. Data security and privacy

We take the security of your information seriously. Personal and financial data is encrypted in transit and at rest, and access is restricted. How we collect, use, store and disclose your information — including CDR data and where data is stored — is set out in our Privacy Policy and CDR Consent Policy, which form part of your agreement with us.

13. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, if required by law, or to protect the security or integrity of the Service. Except where immediate action is necessary (for example, a security risk or unlawful use), we will give you reasonable notice. On termination, the provisions in Section 14 apply, and any fees lawfully owing remain payable. This clause does not limit your rights under the ACL. You may stop using the Service and close your account at any time.

14. Data export and account deletion

You may export your data in JSON or CSV format at any time through Account Settings. On account deletion:

  • Your account is immediately deactivated;
  • CDR data is deleted within 30 days, except where retention is required by law;
  • Other personal data is de-identified or deleted within 90 days;
  • Some records may be retained for legal compliance (e.g., audit logs) for up to 7 years; and
  • Deletion is irreversible and data cannot be recovered.

15. Users outside Australia

The Service is intended for Australian residents and is governed by the laws of Queensland, Australia. CDR features are available only to Australian residents. If you access the Service from outside Australia, you do so on your own initiative and are responsible for compliance with local laws. The Service may not be available or appropriate in all jurisdictions.

16. Dispute resolution

These Terms are governed by the laws of the State of Queensland, Australia. If a dispute arises:

  1. Informal resolution — contact us at support@wealthra.io and we will try to resolve it informally;
  2. Mediation — if informal resolution fails, the parties agree to attempt mediation before commencing litigation; and
  3. Jurisdiction — you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia (or any other court of competent jurisdiction).

For privacy or CDR complaints, contact us first at privacy@wealthra.io (or cdr@wealthra.io for CDR matters). If unresolved, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992, or, for CDR matters, the Australian Competition and Consumer Commission (ACCC) at accc.gov.au. Nothing in this clause limits your rights under the Australian Consumer Law.

17. Modifications to these Terms

We may modify these Terms from time to time. Material changes will be notified by email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. We will record the version and date of the Terms you accept.

18. General

  • Survival. Clauses relating to intellectual property, liability, data, and dispute resolution survive termination.
  • Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control.
  • Assignment. You may not assign these Terms without our consent. We may assign or novate them to a successor entity on notice to you, subject to your rights under this agreement and the law.
  • Notices. We may contact you by email or in-app notification; you can contact us using the details in Section 19.
  • Waiver. A failure to enforce a provision is not a waiver of it.
  • Severability. If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
  • Entire agreement. These Terms, together with our Privacy Policy and CDR Consent Policy, constitute the entire agreement between you and Wealthra regarding the Service.
